13 attorneys general file lawsuit against health reform

UPDATE: Thirteen state attorneys general have joined the legal challenge to the landmark health care reform legislation that President Barack Obama signed into law Tuesday, the Associated Press reports.

The lawsuit — which names the U.S. departments of Health and Human Services, Treasury and Labor — was filed immediately after the president's signing ceremony Tuesday. Attorneys general from Florida, South Carolina, Nebraska, Texas, Michigan, Utah, Pennsylvania, Alabama, South Dakota, Louisiana, Idaho, Washington and Colorado are joining in. Other GOP attorneys general may join the lawsuit later or sue separately.

Of the 13, only one -- Buddy Caldwell of Louisiana -- is a Democrat, notes David Weigel at the Washington Independent. Weigel also reports that three of the attorneys general are running for governor.

The Thomas More Law Center of Ann Arbor plans to file a lawsuit challenging the constitutionality of the new health care legislation. From a statement issued by the center: “Among the constitutional objections raised in the lawsuit will be Congress’s lack of authority to require private citizens to purchase or obtain health care coverage under penalty of federal law, as well as forcing Americans who oppose abortions to fund them with their tax dollars in violation of their fundamental rights of conscience and the free exercise of religion.”

The End of the World As We Knew It?

Were I to wager on the question (which may turn out to be an exercise in reading the mind of Anthony Kennedy), I would expect the Court to uphold the individual mandate. But the day that it does will be a tragic one for the Republic.

    I hope they all attack it from slightly different directions so some lib judges can't throw them all out at once.

      You know, this affects us as individuals. I should look into filing a lawsuit too.

      Unfortunately, what's to keep the judges from being bullied and bought the way the congress was? That was unconstitutional too...
